Tripping Accidents
You may have a claim if you have been injured tripping over a raised paving slab or other defect in a footpath. If the incident happened in a public place your claim will usually be against the Highway Authority (the local council). The claim is dependent on a number of factors:
- the defect must be significant, usually at least 25mm
- the council may have a defence to your claim if they can show a system of inspecting regularly for defects and prove that there was no defect at the last inspection (you can obtain guidelines about the frequency of inspection, contact Marrons for more advice)
What should you do if you have been injured in a tripping accident?
- if your accident is in the street, take some photographs and measurements of the defect and the general location of the defect.
- identify the exact location i.e. the street name a house number or street lamp identification number
