Proving Fault/Negligence

To be able to claim compensation following an accident or having contracted an industrial disease we have to be able to prove that your accident or injury was someone else’s fault or the result of someone else’s negligence and that your injury occurred as a direct result.

In some cases this can be straightforward, for example if you were crossing the road on a pelican crossing when a car drove through the red light and hit you.

In other cases, particularly those arising from workplace accidents, exposure to asbestos or in industrial disease claims, the situation can be more complicated. This is because in the workplace numerous health and safety laws apply.

We are very familiar with the regulations and will be able to tell you if there has been a breach of regulation which may help your compensation case.

Time Limits

In most cases legal proceedings have to be started within three years of the date of the accident.

In an industrial disease case the three year period usually starts with the date of diagnosis.

Remember that in certain limited circumstances even if you are outside the three year limit we may still be able to help, particularly in an industrial disease case.

The best advice is to call us as soon as you think you may have a claim. Even if you are outside the time limit it is still worth talking to us as we may be able to help.

Special rules apply to children’s cases. They have until their 21st birthday to claim. Different rules also apply to injuries which happened at sea or in the air. Contact us for further advice.

Evidence

Remember the better the evidence you have about how your accident occurred, or what work conditions caused your industrial disease, the stronger your case is likely to be.

Things you can do to assist include:

  • Getting the names and contact details of any witnesses who either saw directly what happened or know about the circumstances in which you were injured or contracted your industrial disease
  • Photographs of the accident scene, damaged cars or machine etc
  • Copies of relevant documents e.g. accident report, training records, work history etc
  • Name and reference of any police officer involved
  • Registration numbers and insurance details.
